Introduction

Welcome to Solitaire Dates: Love Notes! These Terms of Service (“Terms”, “Terms of Service”) constitute a legally binding agreement between you and Gamey Studio (“we,” “us,” or “our”) regarding your use of the Solitaire Dates: Love Notes mobile game (the “Game”), this website, and any related content and services we make available (collectively, the “Service”).

Solitaire Dates: Love Notes is published through Manyapps.Work, one of the products of Gamey Studio.

Please read these Terms carefully as they govern your access to and use of the Service. You agree to be bound by these Terms by accessing or using the Service. You may not access or use the Service if you disagree with these Terms. These Terms apply to all individuals, including visitors, players, users, and others who wish to access or use the Service.

Description of Service

Solitaire Dates: Love Notes is a classic Klondike solitaire game with a romance story at its heart. Each hand you win unlocks the next entry in an anime-style character's love notes, along with images and videos to collect. The Game is planned for release on iOS and Android and requires an internet connection to play.

Gamey Studio is a playful little app lab. We design and publish relaxing puzzle games and simple everyday tools and apps, and Manyapps.Work is one of the products through which we make them available. We may update, change, or improve the Game and its story content from time to time.

Changes to these Terms

We may modify these Terms from time to time. If we make material changes, we will notify you via the Service or other means, and the revised Terms will become effective upon your continued use of the Service. You are advised to check this page periodically for any changes. Your continued use of the Service signifies acceptance of the revised Terms. If you disagree with the revised Terms, you must stop using the Service.

Access and Use

Subject to your compliance with these Terms, Gamey Studio grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download, access, and use the Game and the Service solely for your personal, non-commercial use. You may not use the Service for any illegal or unauthorized purpose.

You agree not to copy, modify, distribute, sell, or lease any part of the Service; reverse engineer or attempt to extract the source code of the Game; use cheats, automation, or unauthorized third-party software to alter gameplay or unlock content; or interfere with the proper working of the Service.

Intellectual Property

The Game and all content made available through the Service, including the characters, love notes and story text, artwork, images, videos, card designs, music, logos, and the “Solitaire Dates” name, are the intellectual property of Gamey Studio and its licensors. You may use the Service and its content solely for your personal, non-commercial enjoyment. You do not acquire any ownership rights by using the Service. Gamey Studio reserves all rights not expressly granted in these Terms.

Free Play, In-App Purchases, and Payments

The Game is free to play. The free version includes a limited number of games per day (currently 2) and shows ads.

The optional Unlimited Pass is an in-app purchase that removes the daily game limit, removes all ads, and unlocks Magic Tools. The price and any duration or renewal terms of the Unlimited Pass are shown in the App Store or Google Play before you buy. You agree to pay all applicable fees for the purchases you select. Gamey Studio may change its fees, features, and payment terms by notifying you through the Service or other means. By continuing to use the paid Service after any changes, you agree to the revised terms.

In-app purchases are processed by the platform through which you make them (such as the App Store or Google Play) and are subject to that platform's terms. Except where required by law or by the applicable platform, payments already made are non-refundable. Refund requests should be made through the applicable platform. You are responsible for all taxes associated with your use of the Service.

In-game features such as hints, undo, and Magic Tools, and unlocked story content, have no monetary value and cannot be exchanged for cash or transferred outside the Game.

Feedback

If you send us feedback, suggestions, or other communications about the Service, you represent that you have the right to share them, and you agree that Gamey Studio may use them to improve the Game and the Service without obligation to you.

Privacy Policy

Please refer to our Privacy Policy for information about how we collect, use, and disclose information about you. You acknowledge and agree that you have read and understood our Privacy Policy.

App Store and Google Play

If you download the Game from the Apple App Store or Google Play, you acknowledge that these Terms are between you and Gamey Studio only, and not with Apple Inc. or Google LLC. Your use of the Game must also comply with the terms of the store from which you downloaded it.

Limitation of Liability

To the extent permitted by law, you agree to indemnify and hold us, as well as our officers, directors, employees, and agents, harmless from any indirect, punitive, special, incidental, or consequential damages arising from this agreement, including attorneys' fees and related costs and expenses of litigation and arbitration, whether or not such actions are initiated. This includes claims related to personal injury, property damage, or any violation of federal, state, or local laws, statutes, rules, or regulations. Our liability, if any, shall be limited to the amount paid for the products and/or services, and under no circumstances will there be consequential or punitive damages. Please note that some states may not allow the exclusion or limitation of punitive, incidental, or consequential damages, so the aforementioned limitation or exclusion may not apply to you.

GAMEY STUDIO PROVIDES THE SERVICE ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES. TO THE FULLEST EXTENT PERMITTED BY LAW, GAMEY STUDIO DISCLAIMS ALL WARRANTIES EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BECAUSE THE GAME REQUIRES AN INTERNET CONNECTION, WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

GAMEY STUDIO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICE. GAMEY STUDIO'S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE PRIOR SIX MONTHS.

Indemnification

You agree to defend, indemnify, and hold harmless Gamey Studio from any claims, damages, liabilities, losses, or expenses (including attorneys' fees) arising from your use of the Service or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of California without regard to conflict of law principles. Any dispute arising from these Terms must be resolved exclusively in the state or federal courts located in San Francisco County, California, USA.

Termination

Gamey Studio may terminate your access to the Service at any time for any reason. You may stop using the Service and delete the Game at any time. Upon termination, these Terms will no longer govern your use of the Service; however, you will remain liable for all amounts due for your prior use of the Service up to and including the date of termination.
